Getting married in Canada

Canada legalized same-sex marriage nationwide in 2005 with the Civil Marriage Act, making it one of the first countries in the world to do so. It’s still one of the easiest places for queer couples to marry, including couples from overseas.

Licenses are provincial

There’s no residency requirement. You get your license from the province or territory where you’re marrying, and each one sets its own rules on documents, fees and timing. Ontario, British Columbia and Alberta have no waiting period, while Quebec requires 20 days between your license and the ceremony.

If your home country won’t recognize it

Since 2013, Canadian law has also let couples who married here, but live somewhere that won’t recognize their marriage, get divorced in Canada if they ever need to. Not romantic, but reassuring.

Where couples are saying yes

Our couples have eloped at sunset in Drumheller, hiked to a mountaintop in the Rockies and partied at a Toronto brewery.

Questions couples ask

Can same-sex couples legally marry in Canada?

Yes. Same-sex marriage has been legal nationwide since the Civil Marriage Act of 2005.

Do we need to live in Canada to get married there?

No. Canada has no residency requirement. You just need a marriage license from the province or territory where you marry.

Is there a waiting period?

It depends on the province. Ontario, British Columbia and Alberta have none, while Quebec requires 20 days between issuing the license and the ceremony.

What if our home country doesn’t recognize our marriage?

Canada’s Civil Marriage of Non-residents Act (2013) lets non-resident couples who married in Canada divorce there if their home country won’t grant one.

Can a friend officiate?

Officiant rules vary by province. Some allow temporary or one-day authorizations, so check with the province where you plan to marry.

Legal details last checked October 2026. Requirements vary by province, so always confirm with your provincial vital statistics office.
