Getting married in the USA

Same-sex couples have been able to marry in every state since the Supreme Court’s 2015 Obergefell decision. The Respect for Marriage Act added federal protection in 2022, and in November 2025 the Supreme Court declined to hear a case that asked it to revisit Obergefell. Your marriage is legal, and it’s recognized in every state.

Licenses are local

You get your license where you’re getting married, not where you live, and each state sets its own rules. Waiting periods, how long a license lasts, whether you need witnesses and who can officiate all vary, so check the county clerk’s website for your wedding location early on.

Officiants, friends and self-solemnizing

Most states need an officiant, and in many of them a friend can get ordained online to do the honors. Some states and cities ask officiants to register first. A few states, Colorado among them, let you skip the officiant and solemnize your marriage yourselves.

Marrying from anywhere

Utah County runs a fully online license and ceremony process, and you don’t need to be in Utah to use it. Our guide to getting legally married online walks you through it.

Questions couples ask

Is same-sex marriage legal in every US state?

Yes. Same-sex couples have been able to marry nationwide since 2015, and the Respect for Marriage Act of 2022 requires every state to recognize marriages legally performed in other states.

Do we need to live in a state to get married there?

Generally, no. You get a license from the place you’re marrying, wherever you live. Check that county’s clerk for its specific rules and timing.

Can a friend officiate our wedding?

In most states, yes, usually after getting ordained online. Some states and cities ask officiants to register before the wedding, so check local rules early.

Can we get married without an officiant?

In a few states, yes. Colorado is the best known. Elsewhere you will need an officiant or a judge.

Can we legally marry online?

Yes. Utah County issues licenses and holds ceremonies fully online. The officiant must be in Utah, but the two of you can be anywhere.

Legal details last checked October 2026. Always confirm with the county clerk where you plan to marry.
